The former couple split in September 2016 and when Brad, 54, opted to keep their marital home, he agreed a loan deal with Angelina, 43, where she could borrow the huge sum off him to purchase a new house in Los Angeles and pay him back with added interest.
Angelina’s lawyer Samantha Bley DeJean told PEOPLE in a statement: “Following the incident of September 2016, Angelina and the children needed to move from the family home, which Brad chose to keep, including all of its contents.
“Brad was asked to assist in the expense of a new home for Angelina [and their six children] but instead he loaned Angelina money, for which he is charging her interest on a payment plan.”
The comments from Jolie’s attorney came after Brad hit back following her court filing which alleged he wasn’t paying “meaningful” child support for their children – Maddox, 16, Pax, 14, Zahara, 13, Shiloh, 12, and nine-year-old twins Vivienne and Knox.
Brad’s lawyer Lance Spiegel referred to the $8 million loan in court papers and added that Brad has contributed over $1.3 million “in bills for the benefit of [Jolie] and the minor children”.
Lance’s filing also stated that Brad “adamantly disputes the contention that he has not paid child support”.
However, Angelina’s lawyer insisted that the actor has not been paying his 50 per cent of the children’s expenses.
Bley DeJean said: “Angelina has had to shoulder the majority of those without his contribution for the past two years. Child support is not optional in California.”
“Typically a father of means would pay these expenses voluntarily without the need for a request or court order. We are hopeful that this can be resolved without further delay or posturing.”
Angelina has asked the judge presiding over their case to “bifurcate” their marital status, which means they could dissolve the marriage before resolving other issues in the divorce, including division of assets and custody.
A spokesperson for Angelina said, the aim: “is to provide closure to the marriage in a way that clears a path toward the next stage of their lives and allows her and Brad to recommit as devoted co-parents to their children”.
